Power of Attorney Now Available in Every State With Will Hero

Power of Attorney Is No Longer NSW-Only

Most people know a Will protects your wishes after you pass away — but what about your lifetime? If you ever lose capacity through illness, accident or age, a Power of Attorney lets people you trust step in and make decisions for you.

We first launched Power of Attorney documents for NSW customers. Today, that’s changed in a big way: Will Hero now includes state-specific Power of Attorney documents in every Australian state and territory — and they’re still included free when you create your Will.

What’s Available in Your State

The exact documents differ from state to state, because each state’s laws work differently. Here’s what Will Hero provides in each jurisdiction:

All of these are Enduring documents — meaning they keep working even if you later lose capacity, which is exactly when they matter most.

You’ll also notice the number of documents varies. Some jurisdictions use one combined document (Queensland, the ACT, South Australia and the Northern Territory), while others use two separate documents — one for financial and property matters, and one for medical and lifestyle decisions (New South Wales, Victoria, Western Australia and Tasmania). That’s simply how each jurisdiction’s laws are structured, and Will Hero prepares whichever documents your state requires.

One important Tasmania note: Tasmania is the only state where signing isn’t the final step. Both Tasmanian documents must be registered before they take legal effect — the Enduring Power of Attorney with the Recorder of Titles (Land Titles Office) and the Enduring Guardianship with TASCAT — and each registry charges a government fee. Will Hero still prepares your documents free; those registration fees are paid to the Tasmanian government. Our signing instructions explain exactly how and where to register.

Included Free With Your Will

Your Power of Attorney documents come included at no extra cost when you make your Will with Will Hero — $99 for a single Will, or $158 for a couple. There’s no separate add-on fee. You create your Will and your Power of Attorney together, in the one account.

(The one exception is Tasmania, where the state government charges registration fees to make the documents effective — Will Hero still prepares them free, but those government fees are unavoidable. See the Tasmania note above.)

What Will Hero Doesn’t Offer

To keep things clear, a few documents sit outside our current suite:

• General (non-enduring) Powers of Attorney — Will Hero only provides Enduring documents, which are the standard for estate planning.
• Stand-alone advance care directives. In South Australia, the Advance Care Directive (which covers health and personal decisions) is completed separately through SA Health. In Queensland, the long form (Form 3) and the Advance Health Directive (Form 4) aren’t offered.

How It Works

1. Log into your Will Hero account (or create one if you’re new).
2. Select POA and answer a few guided questions — Will Hero prepares the right documents for your state.
3. Submit for Review — our team checks and prepares your documents.
4. Download and print your documents.
5. Sign and witness following the state-specific instructions we include.
6. Have your attorney (and guardian) sign to accept their role — and, in Tasmania, register both documents before they take effect.

Witnessing rules vary by state, so follow the included instructions carefully — improper witnessing can invalidate the document. The people you appoint also need to sign to accept the role before they can act. And in Tasmania there’s an extra step: both documents must be registered (with government fees) before they have any legal effect.
